Terms of Service

Intaky is a client intake and document collection service, operated from Vietnam. By creating a workspace or using the service you accept these terms. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind it.

1. Beta

Intaky is in beta and free of charge until we announce a general release. During the beta the service is provided on an "as is" and "as available" basis. We do not commit to any level of uptime, and while we take backups (see our Privacy Policy) you should not treat Intaky as the only copy of anything you cannot afford to lose. We will give at least 30 days' notice by email before charging begins, and you may close your workspace instead.

3. Your content, and who is responsible for it

You own the forms, documents and data in your workspace. We claim no rights over them beyond what is needed to run the service for you.

You decide what to collect from your applicants and why, so you are responsible for having a lawful basis to collect it, for telling applicants what you are doing with it, and for answering their requests. We hold it on your behalf and act on your instructions.

If your organisation is subject to a data protection regime that requires specific contractual terms with your suppliers, contact privacy@intaky.com before you start so we can put them in place.

4. Acceptable use

Do not use Intaky to break the law, to collect information you have no right to collect, to host malicious content, or to interfere with the service or other users. Do not attempt to access another workspace's data. We may investigate suspected breaches and act on what we find.

5. Availability and changes

We may change, suspend or withdraw features, and will give reasonable notice of anything that materially reduces what the service does. Occasional downtime for maintenance is to be expected.

6. Suspension and termination

You may close your workspace at any time. We may suspend or terminate access where you breach these terms, where required by law, or where continuing would put other users at risk; except in urgent cases we will tell you first and give you a chance to put it right.

After termination you have 30 days to export your data, during which we will help you get it out. After that we delete it, subject to the backup window described in the Privacy Policy.

7. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited under the law that applies to you.

Subject to that, we are not liable for indirect or consequential loss, loss of profits, revenue, goodwill or anticipated savings, and our total liability arising out of or in connection with these terms is limited to the greater of the fees you paid us in the 12 months before the claim, or US$100. During the beta, when no fees are payable, that figure is US$100.

These terms are written for organisations using Intaky for their work. If you are a consumer, nothing here affects rights you have under your local law.

8. Changes to these terms

We may update these terms. The version and date at the top change with them, and we record which version each workspace accepted at signup. Where a change materially affects your rights we will email workspace administrators at least 30 days beforehand; continuing to use the service after that means you accept the new version.
